This Non-Refund Policy (“Policy”) applies to all wellbeing providers (“Provider,” “you,” or “your”) who subscribe to or utilize the BYOU platform (“Platform”), operated by Luxury Beauty Global Inc. (“BYOU,” “we,” “us,” or “our”). By using the Platform and subscribing to our services, you agree to this Policy in full.
1. Non-Refundable Payments
All fees paid to BYOU, including but not limited to subscription fees, service fees, and transaction fees, are non-refundable under all circumstances, except as explicitly outlined in this Policy.
2. Refund Eligibility
Refunds will only be considered under the following limited condition:

Complete Platform Inaccessibility:
If the BYOU platform becomes entirely non-operational or permanently inactive for all users due to the discontinuation of the Platform or a complete shutdown of operations by BYOU.Examples include:

BYOU permanently ceases its business operations and discontinues the Platform.

The Platform cannot be accessed, and all essential features (e.g., booking system, profile management, payment tools) become permanently unavailable without resolution.
Note: Refunds will not be granted for temporary technical issues, scheduled maintenance, or isolated disruptions that do not constitute permanent Platform inaccessibility.

3. Non-Refundable Circumstances
Refunds will not be issued under any of the following circumstances:

Early Cancellations:
If you choose to cancel your subscription before the agreed term expires, no refunds will be issued. You are responsible for fulfilling your payment obligations for the entire subscription period. -
Inactivity:
Failure to complete your provider profile, respond to client inquiries, utilize Platform tools, or engage with opportunities does not qualify you for a refund. -
General Dissatisfaction:
Refunds will not be granted based on dissatisfaction with the Platform’s performance, services, or inability to secure bookings. -
Technical Issues:
Temporary technical issues, server downtime, minor bugs, or disruptions caused by third-party services (e.g., Stripe) do not qualify for refunds. BYOU reserves the right to resolve technical issues within a reasonable timeframe. -
Negative Review Threats:
Refund requests tied to threats of leaving negative reviews, comments, or feedback will not be entertained. Such behavior may constitute a breach of BYOU’s Terms of Service. -
External Factors:
BYOU is not responsible for issues outside of its control, including but not limited to:-
Internet outages or disruptions affecting the Provider.

User error, device incompatibility, or improper use of the Platform.

4. Alternative Solutions
While refunds are not provided under this Policy, BYOU may, at its sole discretion, offer alternative solutions, including:

Subscription Extensions:
Extending the duration of your subscription period to allow additional time to utilize Platform benefits. -
Additional Support:
Offering enhanced support, tools, or visibility features to help you maximize your experience on the Platform. -
Technical Assistance:
Addressing issues promptly to restore Platform functionality.
5. Refund Request Process
If you believe your situation qualifies for a refund under the Refund Eligibility section, you must follow these steps:

Required Documentation:
Provide the following:-
A detailed explanation of the issue.

Evidence that the Platform is entirely non-operational (e.g., error logs, screenshots).

Any prior communication with BYOU Support regarding the issue.

All refund requests will be reviewed within 30 business days.

You will receive written confirmation of the decision.

BYOU reserves the right to deny refund requests that do not meet the strict eligibility criteria outlined in this Policy.

6. Platform Availability Disclaimer

Scheduled Maintenance:
BYOU may perform routine updates or maintenance to improve Platform performance. These periods may temporarily affect accessibility and do not qualify as complete Platform inaccessibility. -
Technical Disruptions:
BYOU does not guarantee uninterrupted access to the Platform and is not liable for temporary disruptions caused by technical issues, server failures, or third-party service interruptions.
7. Limitation of Liability
To the maximum extent permitted by law:

BYOU’s total liability under this Policy is limited to the amounts paid by you for the current subscription period.

BYOU is not liable for indirect, incidental, consequential, or punitive damages arising from the use of or inability to use the Platform.
8. Amendments to this Policy
BYOU reserves the right to amend or modify this Non-Refund Policy at any time. Any updates will be posted on the Platform and communicated via email. Continued use of the Platform following such changes constitutes acceptance of the revised Policy.
